Email Letter from Mr. Victor West

I, Victor West, do hereby insist and demand that you remove my name, and the name of my agency, Pacific Literary Services, from your list as we have been the victim of spurious and false allegations by the so-called `Write Connection" (Wrong Connection.) I have legally admissable documentary proof that I serve my editorial and literary clients well and diligently. Be advised that `Write Connection' has no legal or logical basis or foundation for its misrepresentations of my agency as I do not charge reading fees or require prospective literary clients to avail themselves of my editorial services. I further advise you to review the entire contents of my website for more pertinent information. This demand is prefatory to further actions, should they become necessary.

Our Response Sent on 6 Dec. 97

Dear Sir,

In response to your email letter to Preditors and Editors received on 4 December 1997, I have visited your web site. Though your web site makes reference to your possession of legally admissible documents as mentioned in your email letter, I found no such documents displayed on the site.

Preditors and Editors is dedicated solely to assisting writers. It has a standing and publicly displayed policy of publishing warning advisements within its site concerning any businesses or individuals we learn of about for whom complaints are circulating. That policy is repeated here for your benefit. "Preditors and Editors is not stating that the following listed businesses or people should be avoided by writers. What we are stating is that complaints have been circulated about them. Therefore, you should use extra caution if dealing with any of the following. Follow the links for more information on what complaints exist." Indeed, if you check the Preditors and Editors site, you'll also find that we admonish writers to use caution in dealing with anyone.

Inasmuch as there are complaints circulating about Pacific Literary Services and you, Preditors and Editors stands on its decision to retain your organization on its warnings list until such time as proof is shown that the complaints are unfounded. This email letter response and your first email letter to Preditors and Editors will also be displayed as a link on the warnings page. At the same time, you might be pleased to know that we also list your site without a warning in the editing services section and have posted a link to your web site on the warnings page so that you might tell your side. We do believe in fair play and we are not trying to deprive you of your ability to earn a livelihood.

Cordially,

Email Letter from Mr. Victor West

Received 8 Dec. 97

Mr. Kuzminski:

Please allow me to explain our American system to you. I do not have to prove my innocence. It is incumbent upon someone making an accusation to supply the evidence, or face the consequences. Either you remove my name, and my agency's name, from your listings, whether you call them `cautionary' or otherwise, or you and/or your representatives will most assuredly see the evidence of the falsehood of the spurious allegations being made against me and my agency, at your cost, in an appropriate forum, in that you are acting as an agent for these misrepresentations. There are no valid complaints against me or my agency.

You say you `visited' my website, but I doubt you carefully read all the information there or you would see that no one is being misled and we are providing a great deal of cautionary information to writers, in a legally and socially acceptable manner, unlike too many others on the net and otherwise. You have acknowledged receipt of my demand letter, to remove my name and my agency's name from your listings, immediately, or further steps will be taken.

Sincerely,

Victor West

Mr. Kuzminski:

I had thought your website was no longer on the net, till again alerted by a correspondent, or else, months ago, I would have asked my attorney to pursue the matter of your making libelous claims about me and my services. I'm again asking you to remove my name from your list of people and organizations to avoid, and that of Pacific Literary Services, on the following grounds:

You state that there may `have been complaints' about me or my services; I assure you there are no VALID complaints. In fact, just last month, on March 9, the local Better Business Bureau called me and announced that, since there have been NO COMPLAINTS, they invited me to join. ("Beau," at the BBB (415) 291-0661.) Moreover, I go out of my way to give my clients MORE THAN THEIR MONEY'S WORTH when providing literary services.

Again, if you will CAREFULLY read the entire text of the information at my website, you'll discover that I do not resort to the dishonest strategies or tactics of some of the unscrupulous people and organizations unfortunately to be found in our industry.

I hope you will remove my name, and that of Pacific Literary Services, from your list of people and organizations to avoid, or exercise extra caution when dealing with. Again, you have no proof of your allegations, of that I am certain, because any accusations or complaints about me or my services are without foundation, and there are no VALID complaints (there are always those few people who lodge invalid complaints; no one has gone away disatisfied except those who expected a great deal of work to be performed on their behalf, without supplying compensation.) I await the courtesy of your reply.

Sincerely,

Victor West
